As data controller, we receive personal information directly from you and in our contractual relationship, our business operations and interactions with you. This Data Privacy Notice covers the personal information we collect from you, or about you, including when you visit and interact with any of our websites that link to this Data Privacy Notice (the “Websites”); purchase products from, and otherwise provide personal information to us, whether offline or online in the context of your relationship with us.  This Data Privacy Notice does not apply to job applicants and employees, who are subject to separate privacy notices.

When we use the term “personal information” in this Data Privacy Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or, where subject to applicable law, a household.

How We Collect Personal Information

Depending on the nature of our relationship with you, we may collect your personal information:

  • Directly from you: We may collect the personal information you provide when you purchase our products and services, enter into a contractual and business relationship with us, contact us, participate in a satisfaction survey, receive our marketing communications, interact with us at in-person events, or otherwise interact with us.

  • Personal identifiers, including name, username, email address, phone number, and mailing address. We collect this information to verify your identity and information, communicate with you, process your purchases and payments, manage our relationship, and provide you with products and services.  We may disclose this information to third parties as described in this policy.
  • Personal Information subject to protection under California law, including the information above in “Personal identifiers” as well as your signature, and bank, financial or credit card information. We use this information to process your purchases, manage our relationship with you and provide you with our products and services.  We may disclose this information to third parties as described in this policy.
  • Commercial information, including the products purchased or considered by customers, information about your account and authentication information, information about your purchases, shipping and billing addresses, your requests and interactions with us. We collect this information to maintain customer records, manage your purchases and payments, manage our relationship, identify trends in our customer relationships, collections activity, and conduct business analytics. We may disclose this information to third parties as described in this policy.
  • Financial information, including the billing information related to your purchases, certain limited credit or debit card information that is used by our payment processor to help fulfill a transaction you have requested. We collect this information to process your payment of products. We may disclose this information to third parties as described in this policy.
  • General location information. Where permitted by applicable law, our Websites may use GPS, the location inferred from your IP address, and other technologies to determine the approximate, location of the devices from which you interact with us. We collect this information to understand your use of our website and services and for targeted marketing and lead management with your consent when required by applicable laws. We may disclose this information to third parties as described in this policy.
  • Inferences drawn from personal information, such as information about your interests or purchase preferences. We collect this information in order to understand your preferences and tailor our communications to you. We may disclose this information to third parties as described in this policy.
  • Sensitive Personal Information, specifically credit or debit card information that is used by our payment processor to help fulfill a transaction you have requested as well as log in credentials for our Websites. We use your Sensitive Personal Information only for legitimate business purposes, including to (i) provide goods or services reasonably expected by an average person; (ii) detect security incidents; (iii) detect and resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell your Sensitive Personal Information.
  • Internet or other electronic network activity information, including browsing history, search history, and information regarding your interaction with our products and services, such as the type of device you use, your device configuration, your device’s unique identifier, the IP address of your device, your operating system, the type of Internet browser that you use, usage information, diagnostic information, browsing information, session summary information. In addition to the above categories of personal information, you may choose to provide us with additional personal information, such as when you create a Compana account or fill in an online or offline form (e.g. information request, query, complaint, etc.).  You may choose not to provide your personal information to us, but in some instances if you do not provide us with your personal information, we may not be able to deliver the product or service requested by you.

How We Disclose Personal Information

Each category of personal information that we collect may be disclosed to the recipients described below for the purposes described in this Data Privacy Notice: 

  • Third-Party Service Providers – In order to carry out your requests, to make various products available to you, to respond to your requests, and for other purposes described in this Data Privacy Notice, we may disclose your personal information to third parties that perform functions on our behalf. These service providers are not authorized to use or disclose the information we disclose to them except as necessary to perform their services or to comply with legal requirements, and they are required to keep the information confidential.
  • Corporate Divisions and Sister Entities – We may disclose the personal information you provide to us in order to globally manage our business. 
  • Business Transfers and Successor Entities – We may disclose your personal information, to parties acquiring all or part of our assets, as well as to attorneys, and consultants. Also, if any bankruptcy or reorganization proceeding is brought by or against us, your personal information may be considered a company asset that may be acquired by or transferred to third parties.
  • Law Enforcement Agencies, Courts, Regulators, Government Authorities, or Other Third Parties – We may transfer and disclose your personal information to third parties (i) to comply with a legal obligation, (ii) when we believe in good faith that the law requires it, (iii) at the request of governmental authorities conducting an investigation, (iv) to verify or enforce our policies, procedures, Terms of Use, and other agreements, or to protect the rights, property, or safety of Compana, our customers, vendors, and business partners, or others, including visitors of our websites (v) to respond to an emergency, (vi) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity or (vii) otherwise to protect the rights, property, safety, or security of third parties, users of our products or services, visitors of to our websites, or the public. 
  • Marketing Partners – We may disclose personal information to third-parties who assist us with our marketing efforts in order to promote our products and services, and to share with you products and services that you may be interested in. In some cases, we may also permit certain network advertising companies and publishers to collect personal information on our websites. In addition, our business partners may access personal information about you that we have combined with such business partners’ data. We may disclose and use non-personal information, such as aggregate user statistics, demographic information, and usage information with third parties. 

 

Browser Signals

  • Do Not Track. Some web browsers have “Do Not Track” or similar features that allow you to tell each website you visit that you do not want your activities on that website tracked. At present, the Websites do not respond to “Do Not Track” signals and consequently, the Websites will continue to collect information about you even if your browser’s “Do Not Track” feature is activated.
  • Global Privacy Control (GPC). Global Privacy Control (GPC) allows individuals to automatically signal their privacy preferences to websites and other online services through their browser or through an extension. If we receive a GPC signal to opt-out of website tracking, we will honor such requests.

 

Links to Other Sites

Our animal health and nutrition Websites and communications may include links to other websites, including to social networks or business partners that may use our logo(s) as part of a co-marketing effort. To the extent that any linked products or services are not provided by Compana, we are not responsible for the products or services, privacy and data collection, use and sharing practices, or any of the content found on these websites. If you provide information on and use third-party services or websites, the privacy policy and terms of service on those websites are applicable. We encourage you to read the privacy policies of those websites. Also, please be advised that if you disclose personal information or personally sensitive information through public forums or message boards, this information may be collected and used by others. We do not monitor these public spaces and take no responsibility for the content, security, or confidentiality of any information posted thereon.

 

How We Protect Personal Information

In proportion to the sensitivity of the information, we maintain reasonable administrative, technical, and/or physical safeguards and reasonable security measures designed to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, or destruction of personal information. Please be aware that, despite our efforts to maintain appropriate technical and organizational security measures, no security system is perfect.

 

Personal Information Retention

We will keep your personal information for as long as we have a relationship with you or until the complete processing of your request. 

Beyond this retention period, we may retain your personal information if legally required or to fulfill a legitimate interest (including pre-litigation and litigation management) or another lawful basis for retaining the information beyond the period which is necessary. We will then delete your personal information or anonymize your personal information so that it is no longer personally identifiable.

 

International Transfers of Personal Information

Compana is a global organization, headquartered in the United States, that does business in many countries, including the United Kingdom.  While Compana has an affiliate entity located in the United Kingdom, Compana does not disclose or receive consumer data from this entity. However, Compana may disclose your personal information with our service providers, brands, affiliates and other business partners, some of which may be located in countries outside of the jurisdiction in which you reside. In the event that such country does not ensure a level of protection of personal information equivalent to the jurisdiction in which you reside, Compana ensures that the transfer is covered by appropriate safeguards (e.g. adequacy decision, standard contractual clauses as adopted by the European Commission, the United Kingdom or any other competent authority, transfer impact assessments, or any alternative legal bases). Children

Our products and services are not directed to children under the age of eighteen (18). We do not knowingly collect personal information from anyone under eighteen (18).  If you become aware that we have collected personal information from someone under the age of eighteen (18), please contact us at privacy@companapetbrands.com.

 

Updates to Our Data Privacy Notice

We may modify or update this Data Privacy Notice from time to time. We will always indicate at the top of this Data Privacy Notice when it was most recently updated. If we materially change this Data Privacy Notice, we will endeavor to notify you of the changes when required by applicable law. Any changes will be effective immediately upon the posting unless otherwise indicated. Where changes to this Data Privacy Notice will have a fundamental impact on the nature of processing or otherwise have a substantial impact on you, we will give you sufficient advance notice so that you have the opportunity to exercise your rights when required by applicable law. Additional U.S. State Law Disclosures

 

Your California Privacy Rights

The California Consumer Privacy Act (“CCPA”) requires us to provide specific disclosures about the personal information we collected in the preceding 12 months. This Data Privacy Notice describes the categories of personal information we collect and sources of information, the business and commercial purposes for collecting personal information, and the categories of third parties we have disclosed personal information with for business and commercial purposes.

In addition: 

  • We have not “sold” any personal information in the traditional sense of the word.  However, we have sold or shared (as those terms are defined in the CCPA) the following categories of personal information with our targeted advertising service providers and partners: Direct Identifiers, Internet Activity Information, and Inferences.
  • We do not knowingly sell the personal information of individuals under the age of 16.
     

We provide California residents the privacy rights required under applicable law, including the CCPA and Shine the Light law, as further described below.

California Individual Privacy Rights:

  • The right to know. You have the right to request to know what personal information we have collected about you, including the categories of personal information we have collected, the categories of sources from which we collected it, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclosed personal information, and the specific pieces of personal information we collected. 
  • The right to correct. You have the right to request that we correct inaccurate personal information that we maintain about you.
  • The right to deletion. You have the right to request that we delete the personal information that we have collected or maintain about you. We may deny your request as permitted by law under certain circumstances, such as if we need to comply with our legal obligations or complete a transaction for which your personal information was collected. If we deny your request for deletion, we will let you know the reason why such request was denied.
  • The right to opt out of the sale or sharing of your personal information. You have the right to opt out of the sale or sharing of your personal information.  You can opt out from the collection and sharing of Performance and Targeting Cookies as described in Cookie Notice.
  • The right to equal service. If you choose to exercise any of these rights, we will not discriminate against you in anyway. If you exercise certain rights, understand that you may be unable to use or access certain features of the website or our services or properties.

Shine the Light: California Civil Code Section 1798.83 gives California residents the rights to request from us once per calendar year certain information regarding our disclosure of their personal information to third parties for those third parties’ direct marketing purposes. You may request information regarding the disclosure of your personal information to third parties for those third parties’ direct marketing purposes by contacting us at privacy@companapetbrands.com.

Financial Incentives

We may offer financial incentives to consumers in exchange for sharing certain personal information with us. Participation and the rewards offered as incentives are set out within each program. Our good faith estimate of the value of your information is the value of the benefit we offer to you. We calculate that value by using the expense to us of operating the program related to the benefit obtained by our running of the program. You can opt-in by signing up for the incentive when it is offered to you. Participation is always optional, and you can opt out of participating at any time as explained in the applicable program terms.

 

State Privacy Rights

We provide residents Nebraska, Texas, or Virginia, with the privacy rights required under applicable law as further described below.

Consumer Privacy Rights:

You may have the following rights, subject to any applicable exemptions or limitations:

  • The right to access. You have the right to confirm whether we are processing your personal information and to access such Personal Information.
  • The right to correct. You have the right to request that we correct inaccurate your personal information that we maintain about you.
  • The right to delete. You have the right to request that we delete your personal information under specific circumstances.
  • The right to opt-out. You have the right to object or opt out of certain types of processing, including: (1) processing for the purpose of targeted advertising, (2) processing for the purpose of the sale of Personal Information, and (3) processing for the purpose of certain types of profiling and automated decision-making.
  • The right to data portability. You have the right to request a copy of your personal information in an accessible format.
  • The right to equal service. If you choose to exercise any of these rights, we will not discriminate against you in anyway. If you exercise certain rights, understand that you may be unable to use or access certain features of the websites or our services or properties.
  • The right to appeal.  If we do not grant your consumer request, you may have the right to appeal that denial.

Submitting a Privacy Rights Request

To exercise any of the state rights above, please submit a request to us by either by calling us at 800.690.9908, or by emailing us at privacy@companapetbrands.com. Making a consumer request does not require you to create an account with us. Applicable law may limit the number of times that you can submit a particular request within a 12-month period.

You or your authorized agent may submit a request on your behalf so long as you provide the authorized agent written permission signed by you to make a request on your behalf, and your authorized agent additionally is able to verify their identity with us. You may also make a verifiable consumer request on behalf of your minor child.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We may require that you provide us with additional information in order to verify your identity.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

We will respond to your request in the time frame require by applicable law (and generally, within 45 days unless a shorter period is required by applicable law).

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
